Inihayag ni Senate President Francis \u201cChiz\u201d Escudero na magdedesisyon ang impeachment court sa Agosto 6 kung itutuloy ang paglilitis sa articles of impeachment laban kay Vice President Sara Duterte.<\/p>\n\n\n\n

Sa pahayag, sinabi ni Escudero na tatalakayin din sa plenaryo ng impeachment court ang desisyon ng Supreme Court hinggil sa petisyon na ipatigil ang impeachment trial laban kay Duterte.<\/p>\n\n\n\n

Aniya, isa itong paglilinaw sa maling news report na ibinasura ng Senado ang tungkulin nito sa ilalim ng Saligang Batas na litisin sa pamamagitan ng impeachment trial si Duterte.<\/p>\n\n\n\n

Noong Martes, nagsagawa ng caucus ang 24-miyembro ng Mataas na Kapulungan na inaprubahan ang pagkilos sa desisyon ng Supreme Court na nagdedeklara sa impeachment case na unconstitutional dahil nilabag nito ang  one-year bar provision sa Charter.<\/p>\n\n\n\n

\u201cThe Senate decides everything as a collegial body. Someone will make a motion and if someone objects, we put it to a vote. So we\u2019ll put this to a debate and vote on August 6 on what to do with the impeachment in light of the Supreme Court decision,\u201d  ayon kay Senate President Escudero.<\/p>\n\n\n\n

Ayon sa lider ng Senado na mapagbibigyan ng pagkakataon sa naturang panahon ang lahat ng senator-judges sa impeachment court upang suriin ang unanimous decision ng Supreme Court na kinabibilanganng 97 pahina kasama ang hiwalay na concurring opinions ng hukom.<\/p>\n\n\n\n

\u201cYung desisyon mismo 97 pages, excluding \u2018yung concurring opinions of the other members of the Supreme Court at hindi naman po lahat ay nag-aral ng abogasiya kaya kung kinakailangan, mabigyan ng konting panahon pa,\u201d ayon sa  veteran legislator. \u201cAko nga humihingi rin ako ng konting panahon pa sa aking mga kasamahan kaugnay ng pagbabasa at pag-unawa dun sa desisyon bago namin igawad ang aming pagpapasya kaugnay nito,\u201d dagdag pa nito.<\/p>\n\n\n\n

Bilang abogado, ipinaliwanag ni Escudero na kailangan suriin nang Mabuti ang desisyon dahil immediately executory ito.<\/p>\n\n\n\n

Sakaling maghain man ng motion for reconsideration ang Mababang Kapulungan sa Supreme Court, sinabi ni Escudero na wala silang alam kung kailan ipalalabas ang desisyon hinggil dito.<\/p>\n\n\n\n

Aniya, unanimous ang desisyon ng Supreme Court at hindi base sa karanasan kaya walang posibilidad na mabaligtad ang desisyon.<\/p>\n\n\n\n

\u201cPwede rin namang hintayin na mag-file muna \u2018yung House of Representatives ng motion for reconsideration. Pero hindi pa maliwanag \u2018yun. Baka mag-antay kami sa wala. At kung hinihintayin namin \u2018yun, kailan na naman magpapasa ang Korte Suprema? In the meantime, anong gagawin namin? Held in abeyance? Postponed muna?\u201d aniya.<\/p>\n\n\n\n

\u201cWe cannot decide based on the mere whim of partisan people who have already taken a position either for or against. I said this at the beginning of the impeachment when it was filed last February 5, hindi ko papakinggan . . . \u2018yung pabor kay VP Sara at ayaw sa impeachment at \u2018yung ayaw kay VP Sara at pabor sa impeachment. I will not be cowed nor bullied by these people into acting one way or the other. We will do what we think is right,\u201d  giit ni Senate President Escudero. <\/p>\n\n\n\n
