Matinding binatikos ni Senate President Francis \u201cChiz\u201d Escudero ang tatlong dating hukom na kritikal sa desisyon ng Supreme Court na nagbabasura sa impeachment trial ni Vice President Sara Duterte.<\/p>\n\n\n\n

Sa kanyang privileged speech kahapon Aug 6, 2025, sinabi ni Escudero na bahagi siya ng Kongreso na nagtangkang patalsikin si dating Chief Justice Hilario Davide na pinigilan ng Korte Suprema dahil sa ilang isyung Konstitusiyunal.<\/p>\n\n\n\n

\u201cBahagi ako ng Kongresong nagtangka na i-impeach si dating Chief Justice Davide. Bakit ko sinabing tangka? Dahil pinigilan po kami ng Korte Suprema. In-enjoin at nag issue ng TRO ang Korte Suprema at ito ang desisyon na iyon,\u201d aniya.<\/p>\n\n\n\n

Matapos ito, nagdesisyon ang mayorya ng Senado na ilagay sa archive ang impeachment trial ni Duterte alinsunod sa desisyon ng Korte Suprema na nagbabasura sa articles of impeachment na isinumite ng Mababang Kapulungan sa Senado noong Pebrero 5.<\/p>\n\n\n\n

Binanggit ni Escudero sina retired SC justices Conchita Carpio-Morales, Antonio Carpio, at Adolfo Azcuna, at  former chief justices Reynato Puno at Artemio Panganiban.<\/p>\n\n\n\n

\u201cThey all voted in 2003 that the second impeachment complaint against then Chief Justice Hilario Davide was barred under Article XI, Section 3(5) of the Constitution, which says \u201cNo impeachment proceedings shall be initiated against the same official more than once within a period of one year,\u201d ayon kay Escudero.<\/p>\n\n\n\n

Aniyal isinulat ni Carpio-Morales, alinsunod sa desisyon sa Francisco vs House of Representatives na sinimulan ang impeachment sa paghahain ng impeachment complaint at referral sa House Committee on Justice, o kung napagbotohan ang impeachment complaint ng one-third ng miyembro ng House.<\/p>\n\n\n\n

\u201cSubalit ngayon tila nag-iba ang posisyon. Ano nga ba ang pinagkaiba kung meron man? Klaro ang pinagkaiba, iba ang pangalan ng nasasakdal,\u201d dagdag niya.<\/p>\n\n\n\n

Nitong Hulyo 25, 2025, ideklara ng Supreme Court ang ikaapat na impeachment complaint na inihain sa Senado na pawang unconstitutional  dahil ipinagbabawal ang one-year ban sa ilalim ng  Article XI, Section 3(5) of the Constitution.<\/p>\n\n\n\n

Kaya tanong ni Escudero na kung tunay ngang accountability o simpleng anti-Dutrte lang ang kritikal sa desisyon ng SC.<\/p>\n\n\n\n

\u201cRemove the name of the vice president in this case, apply the decision of the high court, as Senator Cayetano said earlier, to another impeachable official, would our positions, would your positions be the same?\u201d giit niya. <\/p>\n\n\n\n
