Mahigpit na pinandigan ni Senate Minority Leader Alan Peter Cayetano nitong Miyerkules na dapat tiyakin ng gobyerno na walang Pilipinong nahaharap sa international arrest warrant ang ipadadala sa ibang bansa nang hindi muna binibigyan ng pagkakataon na humingi ng tulong sa lokal na korte.<\/p>\n\n\n\n

Sa kanyang pagco-sponsor ng Senate Resolution No. (SRN) 307 na inihain ng Minority bloc nitong February 25, 2026, idiniin ni Cayetano na ang resolusyon ay isang constitutional safeguard na nakabatay sa aral ng 1987 Constitution.<\/p>\n\n\n\n

\u201cAng pinag-uusapan dito ay ang issue 40 years ago, issue din po ngayon [na] \u2018pag may biglang aarestuhin [na Pilipino,] kailangan ang aarestuhin na \u2018yun ay may pagkakataong pumunta sa Philippine courts to seek remedy,\u201d wika ni Cayetano.<\/p>\n\n\n\n

\u201cIf you look at the International Covenant on Civil and Political Rights, naroon din ito. It\u2019s part of the generally accepted principles of international law,\u201d dagdag niya.<\/p>\n\n\n\n

Ayon kay Cayetano, ang SRN 307 ay para sa lahat ng Pilipino at hindi nakatuon sa kahit sinong personalidad o mga kasong kasalukuyang umiiral.<\/p>\n\n\n\n

\u201cAng substance ng resolusyon na ito [ay] hindi po si dating Pangulong Duterte, na ngayon po ay gumugulong na [ang kaso] at meron nang confirmation of charges. Hindi rin pinag-uusapan dito whether or not we should join or rejoin the ICC,\u201d paliwanag ng minority leader.<\/p>\n\n\n\n

\u201cThis [resolution] deals with all Filipinos from the time that we articulate the \u2018sense of the Senate\u2019 under our constitution,\u201d dagdag niya.<\/p>\n\n\n\n

Binigyang diin niya na mahalaga ang partisipasyon ng korte lalo na sa mga kasong may international arrest warrants.<\/p>\n\n\n\n

Binanggit din niya bilang halimbawa ang Canada, United Kingdom, at South Korea na nag-aatas ng domestic legal process bago hayaang maaresto o maipadala ang isang tao sa ibang bansa.<\/p>\n\n\n\n

\u201cHindi ito simpleng bagay na inatas sa judge. All the jurisprudence will say that the [local] judge has to personally determine, he has to examine the evidence, and believe that there is probable cause,\u201d sabi niya.<\/p>\n\n\n\n

Ayon kay Cayetano, hindi lang ito usapin ng kasalukuyang kontrobersiya kundi pwede ring makaapekto sa mga opisyal o ordinaryong mamamayan sa hinaharap.<\/p>\n\n\n\n

\u201cThere might be issues that we do not know, that might be moot and academic, if you just put a Filipino on a plane and send him abroad. All of us here agree na pagdating sa West Philippine Sea, hindi natin ipamimigay, atin ito. Sana naman pagdating sa kapwa Pilipino, atin \u2018to, kababayan natin \u2018to, tao \u2018to. \u2018Di dapat basta sinusurrender,\u201d sabi ng senador.<\/p>\n\n\n\n

Nagbabala siya na ang paglaktaw sa lokal na korte ay pwedeng magpahina sa proteksyon ng Konstitusyon.<\/p>\n\n\n\n

\u201c\u2018Kapag may warrant na hindi issued ng Philippine judge, kailangan dumaan sa korte iyan. Kung hindi, unconstitutional iyan. At kailangan, ang bawat Pilipino na may tanong at nag si-seek ng remedy ay pwedeng makapunta sa korte ng ating inang bayan,\u201d sabi ni Cayetano.<\/p>\n\n\n\n
