Inaprubahan ng Senado kahapon ang paglilipat sa arikbo ang Article of Impeachment laban  Vice President Sara Duterte sa archives, alinsunod sa desisyon ng Sureme Court na nagdedeklara sa impeachment na pawang unconstitutional.

Sa botong 19 pabor, apat ang tumutol at isa ang hindi bomoto, in-archived ng Senado ang impeachment complaint.

Bukod kay Senate President Francis “Chiz” Escudero, bomoto ng “yes” din sina Senador Alan Peter Cayetano, Pia Cayetano, Ronald “Bato” Dela Rosa, JV Ejercito, Jinggoy Estrada, Sherwin Gatchalian, Bong Go, Lito Lapid, Loren Legarda, Rodante Marcoleta, Erwin Tulfo, Raffy Tulfo, Imee Marcos, and Robin Padilla, Senate Majority Leader Joel Villanueva, Camille Villar, and Mark Villar, at Juan Miguel Zubiri.

Tumutol naman sina Bam Aquino, Risa Hontiveros, Francis “Kiko” Pangilinan, Senate minority leader Vicente “Tito” Sotto III at abstained si Sen. Panfilo “Ping” Lacson.

Naunang inimosyon ni Marcoleta na i-dismis ang articles of impeachment  pero sumangayon ang karamihan na isantabi muna ang Articles of Impeachment.

“Let history, Mr. President, record that in this moment, we chose the Constitution, we chose the rule of law by defending the integrity of the Supreme Court and maintaining the system of checks and balances under our republican system of government,” ayon kay Escudero.

“Let this chamber be remembered not for the passions we inflamed, but the principles we upheld,” dagdag niya. 

Nilinaw naman ni Zubiri na maaari pang ibalik sa plenaryo ang Articles of Impeachment sa gitna ng nakahain na motion for reconsideration na nakabinbin sa Supreme Court.

“That is why I thank the good movant, Mr. President, for allowing the amendment of the motion to make it a mere archiving of the document, because that will never stop us from being able to pull out the document from the archives,” ayon kay Zubiri.

Iginiit naman ni Sotto at ilang miyembro ng minorya na dapat hintayin muna ng Senado ang desisyon ng Supreme Court sa motion for reconsideration na inihain ng Office of the Solicitor-General para sa Mababang Kapulungan.

“How can the Senate archive something that is not before it? The articles are before the impeachment court,” paliwanag ni Sotto, dating Senate President at matagal nang chairman of the Senate Committee on Rules bilang minority leader.

Sinabi naman ni Hontiveros na, “Mr. President, I vote “NO”. The 1987 Constitution entrusted the duty to try and decide all cases of impeachment to the Senate. Today, we are voting to abandon this mandate.”

Inaprubahan ng Mababang Kapulungan noong Pebrero 5 ang articles of impeachment na mayroong 200+ miyembro ang lumagda sa reklamo. Inakusahan si Duterte ng betrayal of public trust, culpable violation of the constitution, graft and corruption, at iba high crimes.

Not guilty ang ipinasok na tugon ni Duterte sa verified impeachment complaint na inihain laban sa kanya.

Kamakailan, ideklara ng Supreme Court na unconstitutional ang articles of impeachment laban kay Duterte na bawal sa one-year rule sa ilalim ng Constitution at nilabag ang kanyang karapatan.

Naghain ng motion for reconsideration ang Mababang Kapulungan sa pamamagitan ng Office of the Solicitor-General upang baligtarin ang desisyon ng Supreme Court.

Ipinaliwanag naman ni Alan Cayetano sa tanong sa mga mambabatas na kung papatayin si Nazi leader Adolf Hitler bilang bata upang maiwasan ang holocaust.

“If you kill Hitler as a six-year-old, if you justify the end by the means, you will create more Hitlers, so if the vice president is guilty, dapat po siya ay i-impeach. Pero sa tamang panahon at tamang proseso,” ayon kay Cayetano.

“Nagsalita na ang Korte Suprema na mali ang proseso, mali ang panahon,” dagdag niya.

Sinabi naman ni Pia Cayetano na ideneklara ng SC ang articles of impeachment bilang null and void o inbalido sa simula’t simula saka iginiit na gusto din nitong suriin ang kaso pero kailangan tumupad ang Senado sa rules.

Sa pagtutol, sinabi ni Hontiveros na gusto lamang niyang tiyakin na may kapangyarihan ang publiko na papanagutin ang sinumang pinakamataas na opisyal ng bansa.  

“Hindi po dapat mahirap at teknikal ang impeachment. Taliwas ito sa intent ng framers. It should not be taxing to hold power to account. Anything that will make it easier for a public officer to evade accountability should be opposed,” ayon kay Hontiveros.

Ipinaliwanag naman ni Legarda, miyembro ng minority bloc na bomoto siya ng pabor dahil hindi dapat salungatin ng Senado ang desisyon ng SC.

“The Court speaks, and at times it speaks again. But until it does, the Senate must not act contrary to what it already said,” ani Legarda.

Hindi naman bomoto nang anumang si Lacson dahil hihintayin muna niya ang desisyon ng Supreme Court sa motion of reconsideration na ihain ng Mababang Kapulungan.
